The controller will use your personal data for processing orders or for the conclusion and performance of a contract that is based on your submitted order.

If you expressly consent to receiving newsletters, we will also process your data for marketing activities, which primarily include receiving newsletters.

You can revoke your consent for processing data for the purpose of receiving newsletters at any time. You can do this by:

4. PERSONAL DATA RETENTION PERIOD

The period of retention of personal data depends on the purpose for which they were collected. We keep the data for as long as necessary to achieve the purpose for which they were collected or further processed, or until the expiry of the limitation periods for fulfilling obligations or the legally prescribed deadline, or until revocation if the data was obtained based on consent. Considering the nature of the processed data and risks, we periodically and in a documented manner verify compliance with the provisions limiting the retention period.

We may also disclose your personal data to state authorities when necessary to enforce, exercise or defend legal claims in a judicial, administrative, or extrajudicial procedure.

6.3. Third-party applications

With your consent, we may share your personal data with third-party applications if you choose to access our services through such an application, as in the case of Facebook and Instagram. The included links do not generate any cookies until the individual clicks on them, so the responsibility for handling your personal data lies with the providers of the applications that you choose to use.

7. DATA TRANSFER TO NON-EU OR EEA COUNTRIES

ADITUM does not perform automated decision-making or profiling.

9. RIGHTS RELATING TO YOUR PERSONAL DATA

You can submit all your requests regarding the exercise of your rights to the personal data controller, Aditum d.o.o., at Puštal 132, 4220 Škofja Loka (with the note “Protection of personal data”) or by email at iztok.petrič@aditum.net.

An individual has the following rights regarding personal data:

9.1. Right to access data

An individual may request at any time that ADITUM company confirms whether it processes data related to them. Based on such a request, ADITUM provides the individual with access to their personal data and provides the following information regarding the processing of their personal data:

• purpose of processing;

• types of personal data concerned;

• recipients or categories of recipients to whom the personal data have been or will be disclosed, especially recipients in third countries or international organizations;

• where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;

• the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing concerning the individual, or to object to such processing;

• the right to lodge a complaint with a supervisory authority;

• where the personal data are not collected from the individual, any available information as to their source;

• the existence of automated decision-making, if any.

Upon meeting the conditions of the General Data Protection Regulation, ADITUM company will communicate to the individual whose personal data have been disclosed all corrections or erasures of personal data or restrictions on processing.

9.2. Right to rectification

An individual can request at any time that the company ADITUM allows him to correct inaccurate personal data relating to him or completion of incomplete personal data.

9.3. Right to erasure

In specific cases (as defined in Article 17 of the General Data Protection Regulation), an individual has the right to request that ADITUM company enables the erasure of their personal data (the so-called right to be forgotten).

The right to be forgotten is part of the General Data Protection Regulation (GDPR) of the European Union, which stipulates that individuals have the right to request the erasure of their personal data if it is no longer necessary for the purposes for which it was collected, if the individual withdraws their consent for the processing of data, if the data was processed unlawfully, or if the data needs to be erased due to legal requirements.

9.4. Right to restriction of processing

An individual to whom personal data relates has the right to request that ADITUM limits the processing in the following cases:

• the individual to whom the personal data relates disputes the accuracy of the data, for a period that allows ADITUM to verify the accuracy of the personal data;

• the processing is unlawful, and the individual to whom the personal data relates opposes the erasure of personal data and instead requests the restriction of their use;

• ADITUM no longer needs the personal data for processing purposes, but the individual to whom the personal data relates needs them for the establishment, exercise, or defense of legal claims;

• the individual to whom the personal data relates has objected to the processing until it is verified whether ADITUM’s legitimate reasons prevail over the individual’s reasons to whom the personal data relates.

9.5. Right to data portability

An individual may at any time request that ADITUM provide them with their personal data relating to them in a structured, commonly used, and machine-readable format. The individual has the right to transmit this data to another controller, and ADITUM shall not hinder them in doing so.

The individual has the right for personal data to be transferred directly from ADITUM as a controller to another controller, when this is technically feasible.

9.6. The right to object

The individual to whom the personal data relates has the right, on the basis of reasons related to his special situation, to object to the processing of personal data concerning him at any time, when ADITUM processes personal data:

• to perform tasks in the public interest,

• when exercising public authority or

• when processing is necessary for legitimate interests.

The company ADITUM will stop processing this personal data, unless it judges that it has justified and legitimate reasons for continuing the processing or if the processing is necessary for legal reasons.

Where personal data is processed for the purposes of direct marketing, the data subject has the right to object at any time to the processing of personal data relating to him for the purposes of such marketing. In this case, ADITUM will stop processing the individual’s personal data for the purpose of direct marketing.

9.7. Right to withdraw consent

The individual whose personal data is being processed has the right to withdraw their consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

9.8. Right to lodge a complaint with the supervisory authority

The individual has the right to lodge a complaint with the Information Commissioner of the Republic of Slovenia if he or she believes that his or her personal data is being processed in violation of the applicable regulations governing the protection of personal data.

9.9. Right to judicial protection

An individual who believes that a data controller or processor in the public or private sector is violating his or her rights under the General Data Protection Regulation or the laws governing the processing or protection of personal data may demand judicial protection of his or her rights for the entire duration of the violation, without prior assertion of rights under other provisions of the Personal Data Protection Act or the use of other legal remedies.

10. CHANGES TO THE PRIVACY POLICY

ADITUM company reserves the right to change the Privacy Policy in accordance with the circumstances and legislation on the protection of personal data.
